Cibus Terms and Conditions of Use

Before accessing and using the services available on the Cibus web application through the domain https://www.cibushealth.com and/or its subdomains, and/or on the Cibus mobile application, the Professional must carefully read these Terms and Conditions of Use (hereinafter "Terms of Use"; "Terms"; "Conditions"; "Terms and Conditions"), which establish the terms under which the Cibus service is used, while defining the participation rules for Professionals registered with this service.

1. General Conditions

1.1. Who We Are?

Cibus is a professional software platform developed in Italy, dedicated to nutritionists and dietitians. Our cloud-based software, with mobile application connectivity, enables nutrition professionals to simplify complex tasks such as managing and analyzing nutritional information for their clients, planning and creating personalized meal plans, and directly monitoring patient progress. The distinctive feature of Cibus is facilitating and improving the client's nutritional journey through an integrated digital experience.

1.2. Definition of Terms

By "Software" we mean all web and mobile applications developed by Cibus. By "Professional" we mean anyone who has access to the restricted client management area through the web or mobile version of the software. By "Patient" or "Client" we mean anyone who has access to the mobile version of the software for nutritional monitoring. By "Active Patient" we mean a patient whose profile has been modified by the Professional in a given month.

1.3. Acceptance Conditions

Registration and use of Cibus depend on full acceptance of these conditions. Any Professional who does not accept these terms will not be able to use the service. Cibus reserves the right to modify the Terms and Conditions at any time, providing prior notice to the Professional.

1.4. Legal Capacity

To use Cibus, the Professional must be eighteen years of age or older. By accessing and using Cibus, the Professional warrants having the legal capacity to perform legal acts.

1.5. Registration

Required registration data includes: first and last name, gender, country of residence, date of birth, email address, and mobile phone number. It is necessary to present certificates attesting to proper registration with the relevant professional association. The Professional guarantees the truthfulness and accuracy of their personal data.

2. Terms of Use for Professionals

2.1. Services Offered

Cibus offers professional tools for complete nutritional practice management: creation and management of personalized meal plans, automatic nutritional calculations, patient database management, appointment calendar, mobile app for patients with always updated meal plans, direct communication with patients, real-time progress monitoring, and electronic invoicing management compliant with Italian regulations.

2.2. Professional Responsibilities

The Professional commits to: respect applicable Professional Codes of Ethics; follow European legislation on personal data protection (GDPR); not transfer their account to third parties; not distribute illegal or harmful content; not violate Cibus intellectual property rights; collect patient information only with their consent and within the limits necessary for service provision.

2.3. Subscription Plans

Cibus offers various subscription plans with all features. Content and pricing depend on the number of Active Patients per month and the subscription period (monthly or annual). Options are available with limited number of active patients or unlimited patients.

2.4. Automatic Renewal

By accepting these Terms, the Professional consents to automatic renewal of their subscription, authorizing charges using the provided payment information.

3. Payment System

3.1. Payment Management

Cibus uses secure payment systems to process transactions. The Professional is responsible for all transactions, including refunds and disputes. Cibus is not responsible for transaction errors or communication issues with payment systems.

3.2. Invoicing

Cibus offers integration with electronic invoicing systems compliant with Italian regulations. The Professional is responsible for correct issuance of invoices to their patients according to applicable tax laws.

4. Final Provisions

4.1. Intellectual Property

All Cibus applications, designs, texts, graphics, logos, and tools are the exclusive property of the platform and protected by copyright laws. Unauthorized reproduction, modification, or distribution of any software element is prohibited.

4.2. Limitation of Liability

Cibus provides no warranties regarding the absence of errors or suitability of the software for specific needs. Cibus is not responsible for direct, indirect, or consequential damages arising from software use.

4.3. Service Suspension

Cibus reserves the right to suspend or terminate account access in case of violation of these Terms, with or without notice depending on the severity of the violation.

4.4. Notifications

Communications between Cibus and the Professional will occur via the email address associated with registration or through other appropriate means available in the software.

4.5. Applicable Law

These Terms and Conditions are governed by Italian law. CIBUS S.R.L., with legal headquarters in Via Pomposa n. 153, 44123 Ferrara (FE), Italy, and operational office at Unite Office – 7th floor, Rosenheimer Str. 116A, 81669 Monaco di Baviera, Germany, represented by the legal representative pro tempore Mr. Matteo Melina. For any disputes, the court of Ferrara, Italy has jurisdiction.
